What Decisions Can Be Appealed?
You can appeal if the Home Office has:

• Refused your protection (asylum) or humanitarian protection claim.
• Refused your human rights claim.
• Refused or revoked your residence document or British citizenship.
• Refused or revoked your status under the EU Settlement Scheme.
• Ordered your deportation under immigration regulations.

How to Appeal
The process differs based on whether you are inside or outside the UK. Appeals can be submitted:

• Online: This is the primary method, especially for solicitors or immigration advisers, through the MyHMCTS service.
• By post: In some cases, such as if the applicant is detained, a paper form can be used.

Outcome of Appeals
The tribunal will either:

• Allow your appeal: This may require the Home Office to reconsider their decision, though it doesn’t automatically grant permission to stay.
• Dismiss your appeal: This means the original decision is upheld.

If your appeal is successful, the tribunal may also order the Home Office to reimburse you for the tribunal fee. However, if you lose, you can apply to the Upper Tribunal if you believe there was a legal error in the decision.

Deadlines and Fees

• You must typically file your appeal within 14 days (if in the UK) or 28 days (if outside the UK).
• The standard fee for an oral hearing is £140, and for a paper-based appeal, it is £80.
