Sponsor Licence Revocation

The revocation of a UK sponsor licence is a serious consequence for organisations authorised to sponsor foreign workers or students in the UK. When a sponsor licence is revoked, it immediately removes the organisation’s ability to sponsor foreign nationals, which can have significant operational impacts. Here’s an overview of why revocations happen, the process involved, and what options are available if a licence is revoked.

Common Reasons for Sponsor Licence Revocation
The Home Office may revoke a sponsor licence if a sponsoring organisation:

  • Fails to meet compliance obligations or repeatedly breaches sponsorship duties, such as record-keeping and reporting obligations.
  • Does not maintain genuine employment for sponsored workers, such as engaging in “sham” employment where roles are fabricated to facilitate visa issuance.
  • Provides incorrect information or documentation in support of licence applications or is involved in illegal practices, including immigration offences.
  • Receives a negative result from a Home Office compliance visit, showing they are not adhering to the “Sponsor Duties” outlined in the Sponsor Guidance.
  • Falls below the required rating (such as downgrading from an A-rating to a B-rating) and fails to improve within a specified period.

The Revocation Process

  • Initial Action: The Home Office will typically issue a “minded to revoke” notice, detailing reasons for revocation and giving the organisation a limited timeframe (often 20 working days) to respond.
  • Response Opportunity: The sponsor may reply to this notice with explanations or evidence showing compliance or that it has taken corrective measures.
  • Final Decision: After reviewing the response, the Home Office may decide either to maintain or revoke the licence.

Immediate Effect of Revocation:

  • Upon revocation, all Certificates of Sponsorship (CoS) held by the organisation are cancelled.
  • Sponsored workers or students are generally required to find a new sponsor within 60 days or leave the UK unless their visa conditions allow otherwise.

Options if a Licence is Revoked

  • Appeal (Judicial Review): There is no direct right of appeal against a revocation decision. However, sponsors may apply for a judicial review to challenge the decision on legal grounds, arguing that the decision was unreasonable, unfair, or procedurally flawed.
  • Re-apply: In some cases, the organisation may re-apply for a sponsor licence, but this option may not be available immediately, especially if the revocation resulted from serious breaches.

Preventing Revocation
To prevent licence revocation, organisations should:

  • Regularly review and update internal compliance processes, ensuring they meet Home Office requirements.
  • Keep meticulous records and report any relevant changes in a timely manner.
  • Conduct internal audits, especially prior to any Home Office compliance visit, to identify and correct any gaps.
