UK Expansion Worker Visa

The UK Expansion Worker Visa is a subcategory of the UK Global Business Mobility (GBM) visa route. It is designed to allow overseas businesses to send senior employees or specialists to the UK to establish a new branch or subsidiary. Introduced as a replacement for the Sole Representative Visa in some contexts, the UK Expansion Worker Visa is intended for companies that do not yet have a UK presence but want to expand operations into the UK.

Purpose of the UK Expansion Worker Visa

  • The visa enables an overseas business to send senior managers or specialist employees to the UK to set up a new branch or subsidiary.
  • Unlike the Sole Representative Visa, which is for a single representative, the UK Expansion Worker Visa allows multiple individuals to be sent to the UK to support the establishment of the business.

Eligibility Criteria for Applicants
Applicants must meet specific criteria to be eligible for the UK Expansion Worker Visa:

  • Existing Employment: The applicant must be employed by the overseas company that intends to expand into the UK and must have worked with that company for at least 12 months before the application, unless they are earning £73,900 or more.
  • Skill Level: The role must meet at least RQF Level 6, which is the equivalent of graduate-level work. This includes positions such as managers, executives, and specialist roles essential to the company’s expansion.
  • Salary Requirement: The applicant must earn a minimum salary of £42,400 per year or the going rate for the job (whichever is higher).
  • Certificate of Sponsorship (CoS): Applicants must have a valid Certificate of Sponsorship from a UK-licensed sponsor (the UK branch or subsidiary of their company or an affiliated entity with a sponsor licence).

Eligibility Criteria for the Overseas Business

  • Sponsor Licence Requirement: The overseas business must obtain a sponsor licence to use this visa category, even though the UK branch or subsidiary is not yet fully established. This requires the company to apply for a temporary sponsor licence with the Home Office, specifically for the purpose of expansion.
  • Genuine Expansion Plan: The overseas business must have a viable plan to establish a UK branch or subsidiary, with a clear strategy for expansion.
  • No Active Trading Presence in the UK: The company must not already be actively trading in the UK. However, it may have a limited presence, such as a representative office, that is not engaged in substantive business activities.

Visa Duration and Extensions

  • Initial Duration: The UK Expansion Worker Visa is typically granted for an initial period of up to 1 year.
  • Extensions: The visa can be extended for another 12 months, allowing a maximum total stay of 2 years.
  • No Path to Settlement: The UK Expansion Worker Visa does not directly lead to Indefinite Leave to Remain (ILR) in the UK. It is intended for temporary purposes, so holders must explore other visa options if they wish to stay in the UK longer or seek settlement.

Permitted Activities and Limitations

  • Work for the Sponsor: Visa holders are permitted to work only for the employer that sponsored them and specifically to set up the UK branch or subsidiary.
  • Limitations on Other Employment: The visa holder cannot undertake any other employment outside the activities needed to establish the business.
  • Bringing Dependents: Visa holders can bring dependents (spouse/partner and children under 18) with them to the UK, and dependents will have the right to work and study in the UK.

Application Process
The application process for a UK Expansion Worker Visa generally involves the following steps:

  • Step 1: Obtain a Sponsor Licence
    1. The overseas company must apply for a sponsor licence through the UK Home Office. They will need to demonstrate their business’s legitimacy, their intent to establish operations in the UK, and their need to transfer the employee(s) to facilitate the expansion.
  • Step 2: Certificate of Sponsorship (CoS)
    1. Once the sponsor licence is granted, the UK branch can issue a Certificate of Sponsorship for the employee(s) they wish to transfer. This will include details of the job, salary, and purpose of the role in the UK.
  • Step 3: Online Visa Application
    1. The applicant completes the online application, pays the visa application fee, and pays the Immigration Health Surcharge (IHS), which grants access to the NHS.
  • Step 4: Biometric Appointment
    1. The applicant must attend a biometric appointment (for fingerprints and photo) and provide supporting documents, such as proof of employment, details of the role, and evidence of the business’s intent to establish UK operations.

Benefits and Limitations

  • Benefits: The UK Expansion Worker Visa provides flexibility by allowing multiple senior employees or specialists to come to the UK and work together in establishing the business.
  • Limitations: Since the visa does not lead to ILR, it’s intended for temporary expansion purposes, and holders must explore other visa categories for long-term residence or settlement.
