Senior/Specialist Worker Visa

The Senior or Specialist Worker Visa is a subcategory of the UK’s Global Business Mobility (GBM) visa, designed for overseas employees in senior or specialist roles who are being transferred to the UK branch of their multinational company. This visa route is intended for high-level executives, managers, or specialists whose skills and expertise are critical to the company’s UK operations. It replaced the previous Intra-Company Transfer (ICT) visa.
Here’s a comprehensive overview of the Senior or Specialist Worker Visa, including eligibility criteria, visa duration, and the application process.

Purpose of the Senior or Specialist Worker Visa

  • The Senior or Specialist Worker Visa allows multinational companies to transfer high-ranking employees or those with specialist skills to their UK offices or subsidiaries to support business operations.
  • It’s suitable for employees with specific expertise or leadership roles that are essential to the company’s work in the UK.

Eligibility Criteria for Applicants
To qualify for a Senior or Specialist Worker Visa, applicants must meet the following criteria:

  • Employment Requirement: The applicant must already be employed by the overseas company that holds the UK sponsor licence. They must have worked for this company for at least 12 months unless they are earning at least £73,900 per year, in which case this requirement is waived.
  • Skill Level: The role must meet the skill requirement of RQF Level 6 (graduate level), which is typically equivalent to roles requiring a bachelor’s degree or equivalent qualifications or expertise.
  • Salary Requirement: The applicant must meet or exceed:
    1. £45,800 per year, or
    2. The “going rate” for the role (as defined by the Home Office), whichever is higher.
  • Certificate of Sponsorship (CoS): The applicant must have a valid CoS issued by the UK sponsor (their UK branch or affiliated company) confirming details about the job and salary.

Sponsor Requirements

  • The UK entity must be a licensed sponsor and authorised by the Home Office to sponsor applicants under the Senior or Specialist Worker route.
  • The UK sponsor must issue a Certificate of Sponsorship that includes detailed information about the job role, salary, and the duration of employment.

Visa Duration and Extensions

  • Initial Duration: The visa is granted for up to 5 years initially.
  • Maximum Duration: Senior or Specialist Workers can stay in the UK for a total of:
    1. 5 years in any 6-year period for those earning under £73,900, or
    2. 9 years in any 10-year period for those earning £73,900 or more.
  • Extensions: Extensions are available, provided the employee meets the requirements and does not exceed the maximum stay period.
  • No Path to Settlement: This visa does not directly lead to Indefinite Leave to Remain (ILR). However, holders may switch to other visa categories, such as the Skilled Worker Visa, if they wish to pursue a route with a path to settlement.

Permitted Activities and Limitations

  • Permitted Activities: Visa holders can only work in the role specified in their CoS for the sponsoring company.
  • Limited Flexibility: The visa does not allow the holder to change employers or roles without a new sponsorship application. Secondary employment outside the sponsoring company is typically not permitted, though certain supplementary work may be allowed under strict conditions.

Application Process

  • Step 1: Obtain a Certificate of Sponsorship from the UK branch or sponsor company.
  • Step 2: Complete the online visa application, pay the visa application fee, and pay the Immigration Health Surcharge (IHS).
  • Step 3: Attend a biometric appointment (if required) and submit necessary documents, such as proof of employment, job details, and salary confirmation.

Benefits and Limitations

  • Benefits: The Senior or Specialist Worker Visa enables companies to transfer essential employees with minimal delay, which helps maintain continuity in operations and expertise across international branches.
  • Limitations: This visa is temporary and does not lead to settlement. Additionally, the holder cannot change employers without a new visa application, limiting flexibility for the worker.

Comparing with Other Routes

  • While the Skilled Worker Visa offers a path to settlement and more flexibility in employment options, the Senior or Specialist Worker Visa may be preferable for those planning to stay temporarily or are tied to a specific role within a multinational company.
