20 Year Private Life Route
The 20-Year Private Life Route is a pathway to obtain limited leave to remain (and eventually settlement) in the UK based on long-term residency and personal life connections in the UK. This route is applicable for those who have lived in the UK continuously for 20 years, including those without lawful residence.
Key Points of the 20-Year Private Life Route
Eligibility Requirements:
- 20 Years Continuous Residence: Applicants must have lived continuously in the UK for at least 20 years, whether lawfully or unlawfully. “Continuous residence” generally means that the applicant has not been absent from the UK for more than 6 months at a time or more than 18 months in total over the 20-year period.
- Private Life Considerations: This route falls under the human rights and private life provisions within UK immigration law (primarily Article 8 of the European Convention on Human Rights). It recognizes an individual’s right to family and private life, where long-term connections to the UK make it unreasonable to require the applicant to leave the country.
Application Process and Limited Leave to Remain
- Limited Leave to Remain (30 Months): An initial grant of 30 months’ limited leave to remain is typically given upon a successful application.
- Extensions Required: The applicant must renew their leave every 30 months until reaching a cumulative 10 years of limited leave on this route to qualify for Indefinite Leave to Remain (ILR).
- Form: Applications are made using Form FLR(FP) (Further Leave to Remain based on Family and Private Life).
Knowledge of Language and Life Requirements
- Applicants will not need to meet the Life in the UK Test or English language requirements until they apply for ILR (after completing 10 years of limited leave on this route).
- Fees and Biometric Requirements
- The application fee includes the cost for biometric enrolment, and applicants must also pay the Immigration Health Surcharge (IHS) as part of each application, granting access to NHS services.
- Fee Waivers: Those who cannot afford the application fee or IHS may apply for a fee waiver based on their financial situation.
Route to Settlement
- After 10 years of limited leave to remain (i.e., four successful 30-month extensions), applicants can apply for Indefinite Leave to Remain (ILR).
- Applicants will need to satisfy English language requirements and pass the Life in the UK Test when applying for ILR under this route.
Considerations and Challenges
- No Automatic Path to Citizenship: Unlike the 10-Year Route based on long residence, this route is lengthy as it requires 10 years of limited leave following the 20 years of continuous residence.
- Documenting Residence: Evidence of 20 years of continuous residence is crucial and may include housing records, bills, school records, and other documentation.
- Human Rights Basis: Applicants may need to justify their connection to the UK and prove how leaving would interfere with their established private life.
