Same Sex Visa
The UK recognizes and supports applications from same-sex partners under the same rules and conditions as opposite-sex couples. Whether you’re in a civil partnership, married, or in a durable, long-term relationship, you may be eligible to apply for a Same-Sex Partner Visa. This visa allows you to live in the UK with your British or settled partner, provided you meet the necessary requirements.
Types of Same-Sex Partner Visas
- Same-Sex Spouse or Civil Partner Visa
If you are married or in a civil partnership with a British citizen or someone who is settled in the UK, you can apply for a visa to join them. This visa falls under the UK’s family visa category, and the process is similar to that for opposite-sex married couples. - Unmarried Same-Sex Partner Visa
If you are not married or in a civil partnership but are in a long-term, durable relationship with a British citizen or someone settled in the UK, you may still apply for a partner visa. To qualify, you must demonstrate that you have been living together for at least two years in a relationship akin to marriage.
Same-Sex Partner Visa Requirements
To successfully apply for a Same-Sex Partner Visa, you must meet the following requirements:
- Genuine and Subsisting Relationship
You must provide evidence that your relationship is genuine and ongoing. This may include documents showing joint finances, cohabitation, and communication between you and your partner. - Living Together for Unmarried Partners
If you’re applying as an unmarried partner, you must show that you have been living together in a relationship akin to marriage or civil partnership for at least two years before applying. - Financial Requirement
Your combined gross annual income with your partner must be at least £29,000. This ensures that you can support yourselves without relying on public funds. In some cases, this requirement may not apply if your partner is receiving certain disability or carer’s benefits. - Accommodation
You must have suitable accommodation arranged for you and your partner in the UK. - English Language Requirement
You must meet the English language requirement, which is at least level A1 for your initial visa application. This is to ensure that you can communicate effectively while living in the UK.
Exceptions for Applicants on Disability or Carer’s Benefits
If your partner is receiving certain disability or carer’s benefits, such as Disability Living Allowance or Personal Independence Payment, the minimum income requirement may not apply. This provides financial flexibility for applicants who are supporting or being supported by someone with special needs.
Pathway to Indefinite Leave to Remain (ILR)
After living in the UK for five years on a Same-Sex Partner Visa, you can apply for Indefinite Leave to Remain (ILR), which grants permanent residency in the UK.
To qualify for ILR, you must meet the following criteria:
- Continuous Residence: You must have lived in the UK continuously for five years on a valid partner visa.
- Genuine Relationship: You must provide evidence that your relationship with your partner is genuine and ongoing.
- English Language and Life in the UK Test: You must meet the required level of English proficiency and pass the Life in the UK test.
- Accommodation and Financial Requirements: You must continue to meet the accommodation and financial requirements, demonstrating that you can support yourself without relying on public funds.
